ChatGPT DSA Designation: Now a Search Engine in the EU

The ChatGPT DSA designation landed on 31 August 2026, when the European Commission designated ChatGPT as a Very Large Online Search Engine (VLOSE) and designated Reddit and Roblox as Very Large Online Platforms (VLOPs), under the Digital Services Act. All three declared at least 45 million average monthly users in the EU. They have four months, until January 2027, to comply.

The ChatGPT DSA designation is the formal decision that places OpenAI's ChatGPT in the highest supervision tier of the EU's platform law. In plain terms, the Commission now treats ChatGPT as a search engine large enough to need systemic risk assessment, and gains powers to look inside how it works.

What did the European Commission announce on 31 August 2026?

The Commission's press release, published on 31 August 2026 and updated on 1 September 2026, confirms three designations under the Digital Services Act package. ChatGPT becomes a Very Large Online Search Engine. Reddit and Roblox become Very Large Online Platforms.

Designation follows a declared user threshold. According to the Commission, these services declared that they reach at least 45 million average monthly users in the EU, which is the trigger point for the extra obligations. With these three, the Commission has now designated 28 very large online platforms and search engines under the DSA.

Why is ChatGPT classed as a search engine and not a platform?

The Commission describes ChatGPT as an Artificial Intelligence system that can engage with and respond to users' prompts and queries, including by searching the web. On that basis it calls ChatGPT a hybrid service that qualifies as an online search engine under the DSA.

Reddit and Roblox fall the other side of the line. The Commission describes Reddit as a discussion-based platform where users create, share and interact with content in topic-based communities. Roblox is described as an immersive gaming and creation platform where users create, publish and play games made by other users. Because both let users disseminate third-party content to the public, they qualify as online platforms.

That distinction matters commercially. A regulator has now said, in writing, that an assistant answering prompts by searching the web belongs in the same legal category as a search engine.

The Commission will supervise compliance in cooperation with these bodies. Both act as Digital Services Coordinators, which share DSA enforcement with the Commission across member states.

What must ChatGPT, Reddit and Roblox do by January 2027?

The four-month clock runs from notification of the designations. By January 2027, each service must meet the additional DSA obligations for VLOPs and VLOSEs. The Commission lists the core duty as assessing and mitigating systemic risks from the service and its algorithmic systems.

The named risk areas are specific:

  • Illegal content: the dissemination of illegal content through the service.
  • Minors: negative effects on minors, which is the sharpest point for Roblox given its user-created games.
  • Well-being: effects on users' physical and mental well-being.
  • Fundamental rights: risks to rights protected under EU law.
  • Elections and public security: effects on electoral processes and public security.

The Commission also gains investigative powers to assess the functionalities behind these services and, where applicable, any related system. All three were already subject to the general DSA obligations for online platforms and search engines. The designation adds a tier, it does not start from zero.

What the ChatGPT DSA designation changes for growth and search teams

The immediate change is legal, not technical. No ranking system moved this week. But the framing has shifted, and framing tends to arrive in product later.

  • Answer surfaces are now regulated surfaces: ChatGPT's classification as a search engine puts assistant answers inside the same supervisory frame as classic search results in the EU.
  • Algorithmic systems are in scope: the obligation covers risks stemming from the service and its algorithmic systems, which is the part that decides what gets retrieved and cited.
  • Reddit sits inside the tier too: a source many teams rely on for visibility in AI answers is now a designated VLOP with its own systemic risk duties.
  • Two regulators, two timelines: Coimisiún na Meán for ChatGPT and ACM for Reddit and Roblox means enforcement pressure may land unevenly.

My read is that risk mitigation work tends to make systems more conservative in sensitive categories first. If you operate in health, finance, elections-adjacent content or anything touching minors, that is the observation to plan against. It is a prediction, not a fact in the source text.

The counter-view

The Commission has not announced a single change to how ChatGPT retrieves, ranks or cites. Designation is a supervisory step with a January 2027 deadline attached. Compliance can be met with governance, documentation and reporting rather than visible product change. Twenty-five services were designated before these three, and the practical effect on organic visibility has varied widely. Reading a traffic shock into this announcement would be overreach.

What to do this week about the ChatGPT DSA designation

  1. Log the January 2027 deadline against your EU risk register, and note which of your categories map to the Commission's five named risk areas.
